Data Protection law change on 25 May 2018

This privacy policy has been updated in line with the new General Data Protection Regulation that comes into effect on 25 May 2018. For the purposes of GDPR and the Data Protection Act 1988 the Data controller in relation to the information held is Fenn Utilities

Why do we have a privacy policy?

Fenn Utilities want you to feel comfortable with the personal information that we hold.  We are committed to protecting and respecting your personal information.  We promise not to sell your data.

What is covered in this privacy policy?

This privacy policy covers the collection and use of personal information and lets you know what happens to any personal information that you or your employer gives to us, or any that we may collect from or about you. It applies to all products and services, and instances where we collect your personal information.

What is not covered in this privacy policy?

Our privacy policy does not apply to the practices of companies that Fenn Utilities does not own or control or to people that Fenn Utilities does not employ or manage.

Updates to our privacy policy

Fenn Utilities may amend this privacy policy from time to time to reflect changes in the law or our privacy practices. If we make any substantial changes in the way we use your personal information we will notify you by posting a prominent announcement on our website or by emailing you.

Our Business

As a commercial and industrial energy management consultant and Energy Savings Opportunity Scheme ESOS assessor our clients are large businesses and large organisations.

We don’t have any individuals or small businesses as clients.

What personal information is collected?

The only personal information we collect is the contact details for some individuals employed by our large business and large organisation clients and our suppliers, which is necessary for our work in providing a service and communication with our clients and suppliers.   

This would normally include the following information :

Name

Work Title /  Occupation

Work Address

Telephone Number

Email Address

It may also include transport details, such as company vehicle and business mileage travelled, when this information is needed for us to complete a transport energy audit and assessment for our large business or large organisation client , as required by the ESOS legislation and regulations.

How is the personal information used?

Fenn Utilities uses your personal data to fulfil our obligations to your employer and provide  our energy management services and help your employer secure their ESOS compliance.  Or if you employed by one of our suppliers, to obtain the business services we require.

How is the information shared or disclosed?

Fenn Utilities will not sell or rent your personal information to anyone. However, it is sometimes necessary to provide this information to the Environment Agency, when they are auditing your employer’s  ESOS assessment and ESOS compliance.

How is the information kept safe?

We have appropriate security measures in place to prevent personal information from being accidentally lost or used or accessed in an unauthorised way. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality.

We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

How long do we keep your personal information?

We will keep your personal information for as long as we have reasonable business needs, which includes managing our ongoing relationship with your employer. Thereafter we will keep your personal information in line with legal and regulatory requirements or guidance.

Enquiries

If we receive an enquiry by post, phone call or form completion then we will retain the details for a limited time and delete the data once it is no longer required or relevant.

How to get a copy of your personal information

You have the right to receive a copy of the personal information we hold about you at any time. Please contact us by email or in writing if you require a copy of the information we hold

How to let us know if your personal information is incorrect

You have the right to question any information we have about you that you think is wrong or incomplete. Please contact us if you want to do this and we will take reasonable steps to check its accuracy and correct it.

How to object to the use of your personal information

You have the right to object to our use of your personal information, or to ask us to delete, remove, or stop using your personal information if there is no need for us to keep it. This is known as the ‘right to object’ and ‘right to erasure’, or the ‘right to be forgotten’.

There may be legal or other official reasons why we need to keep or use your data. But please tell us if you think that we should not be using it.

How to withdraw your consent

You can update your contact preferences at any time by contacting us.

If you withdraw your consent, we may not be able to provide certain services to your employer. So, in the first instance, we would suggest you initially discuss your concerns with your employer.
